    GIỮA CHÍNH PHỦ NƯỚC CỘNG HÒA XÃ HỘI CHỦ NGHĨA VIỆT NAM VÀ CHÍNH PHỦ NƯỚC CỘNG HÒA U-DƠ-BÊ-KI-XTAN VỀ HỢP TÁC TRONG LĨNH VỰC KIỂM DỊCH THỰC VẬT

     

    Chính phủ nước Cộng hòa xã hội chủ nghĩa Việt Nam và Chính phủ nước Cộng hòa U-dơ-bê-ki-xtan (sau đây gọi tắt là các Bên);

    Với mục đích tăng cường hợp tác trong lĩnh vực kiểm dịch thực vật và nâng cao công tác bảo vệ thực vật của cả hai Bên, ngăn chặn sự lây lan của dịch hại kiểm dịch thực vật vào lãnh thổ quốc gia của các Bên, tránh thiệt hại do dịch hại kiểm dịch thực vật gây ra;

    Sẵn sàng thúc đẩy mậu dịch và trao đổi giữa hai nước hạt giống, vật liệu làm giống và các sản phẩm khác thuộc diện kiểm dịch thực vật;

    Đã thỏa thuận các nội dung sau:

    Điều 1. Định nghĩa

    Nhằm mục đích của Hiệp định này, các thuật ngữ sau đây được sử dụng:

    - “dịch hại KDTV” – dịch hại, tác nhân gây hại (sinh học) và cỏ dại, theo các Danh mục nêu trong Phụ lục 1 và Phụ lục 2;

    - “thiên địch” – sinh vật ăn côn trùng;

    - “bẫy bả” – các chất do côn trùng tiết ra để hấp dẫn cá thể trong loài;

    - “chế phẩm sinh học” – chế phẩm có vi sinh vật gây bệnh ở dạng tiềm tàng để phòng chống côn  trùng có hại;

    - “vật thể thuộc diện KDTV” – vật liệu giúp các sinh vật thuộc diện kiểm dịch lây lan (gồm hạt giống, vật liệu làm giống, cây và các bộ phận của cây, các sản phẩm khác có nguồn gốc thực vật), được nhập/xuất khẩu hoặc đang quá cảnh qua lãnh thổ các Bên.

    Điều 2. Tăng cường hợp tác

    Để phát triển hợp tác trong lĩnh vực kiểm dịch thực vật, các Bên phải:

    - tiến hành các biện pháp cần thiết để ngăn chặn các dịch hại kiểm dịch thực vật lây lan từ lãnh thổ Bên này sang lãnh thổ của Bên kia trong quá trình các vật thể thuộc diện kiểm dịch thực vật nhập khẩu, xuất khẩu và quá cảnh;

    - thường xuyên trao đổi thông tin bằng văn bản về sự xuất hiện, lây lan của dịch hại kiểm dịch thực vật trong lãnh thổ của các Bên cũng như trao đổi thiên địch, bẫy bả, tác nhân sinh học và các chất khác để giảm sinh vật thuộc diện kiểm dịch;

    - thông báo các điều khoản sửa đổi và bổ sung đối với các quy tắc kiểm dịch thực vật điều chỉnh việc xuất khẩu, nhập khẩu và quá cảnh các vật liệu thuộc diện kiểm dịch;

    - hỗ trợ khoa học, kỹ thuật và tư vấn về thực hiện các biện pháp phát hiện, khoanh vùng và xử lý các dịch hại kiểm dịch thực vật;

    - phân tích vấn đề và nghiên cứu thành tựu trong lĩnh vực kiểm dịch thực vật, giải quyết hiệu quả các vấn đề liên quan đến kiểm dịch thực vật tại các điểm biên giới;

    - tổ chức cho chuyên gia hai bên phối hợp kiểm tra tại nước xuất khẩu đối với các vật thể thuộc diện kiểm dịch thực vật;

    - trong trường hợp khẩn cấp trong lĩnh vực kiểm dịch thực vật, khi một Bên yêu cầu, phải gửi đoàn chuyên gia thực hiện các biện pháp khẩn cấp chung.

    Điều 3. Kiểm dịch thực vật

    Bất kỳ vật thể thuộc diện kiểm dịch thực vật nào được vận chuyển từ Bên này sang Bên kia phải tuân thủ các quy định sau:

    1. Vật thể thuộc diện kiểm dịch thực vật được vận chuyển từ Bên này sang Bên kia phải tuân thủ các quy định về kiểm dịch thực vật của Bên kia.

    2. Vật thể thuộc diện kiểm dịch phải được thực hiện kiểm dịch chặt chẽ trước khi xuất khẩu.

    3. Trong trường hợp phát hiện vật thể bị nhiễm dịch hại kiểm dịch thực vật của nước nhập khẩu, mỗi Bên có quyền áp dụng các biện pháp cần thiết để bảo vệ thực vật, sản phẩm thực vật trong lãnh thổ nước mình theo pháp luật hiện hành của mỗi Bên.

    4. Cấm sử dụng rơm, lá và các vật liệu thực vật khác có khả năng mang các loại dịch hại làm vật liệu bao gói hoặc chèn lót, ngoại trừ giấy và các vật liệu tổng hợp.

    5. Phương tiện vận chuyển, bao gói và vật liệu chèn lót phải được làm sạch hoặc xử lý khử trùng trước khi xuất khẩu.

    Vật liệu bao gói, chèn lót bằng gỗ phải được xử lý theo quy định tại Tiêu chuẩn quốc tế số 15 về các biện pháp kiểm dịch thực vất (ISPM 15)

    6. Trong trường hợp cần thiết, các Bên sẽ phối hợp cùng nhau để thực hiện kiểm dịch thực vật tại lãnh thổ nước xuất khẩu.

    Điều 4. Giấy chứng nhận kiểm dịch thực vật

    Mỗi lô hàng thuộc diện kiểm dịch được vận chuyển từ lãnh thổ Bên này sang (hoặc qua) lãnh thổ Bên kia phải có chứng nhận kiểm dịch thực vật do cơ quan kiểm soát kiểm dịch thực vật của Bên xuất khẩu cấp và chứng nhận vật thể này đạt yêu cầu kiểm dịch thực vật Bên nhập khẩu đưa ra. Chứng nhận kiểm dịch thực vật phải được trình bày bằng quốc ngữ của Bên xuất khẩu và tiếng Anh. Các mẫu giấy này phải được các Bên trao đổi cho nhau và thông báo kịp thời cho Bên kia trong trường hợp có sự thay đổi mẫu giấy.

    Vật thể thuộc diện kiểm dịch thực vật được nhập khẩu hoặc quá cảnh vào (hoặc qua) lãnh thổ của Bên nhập khẩu trên cơ sở và điều kiện được xác định trong giấy phép kiểm dịch thực vật để nhập khẩu do cơ quan kiểm soát kiểm dịch thực vật của Bên nhập khẩu cấp.

    Điều 5. Kiểm tra và thông báo

    Trong quá trình nhập khẩu hoặc quá cảnh vật thể thuộc diện kiểm dịch thực vật nào đó, các cơ quan chức năng của các Bên có quyền đưa ra điều kiện và yêu cầu bổ sung liên quan đến kiểm dịch thực vật.

    Nếu phát hiện thấy các sinh vật thuộc diện kiểm dịch trong quá trình kiểm dịch tại Bên nhập khẩu, các cơ quan chức năng của các Bên có quyền trả lại vật thể thuộc diện kiểm dịch về nước xuất khẩu hoặc tiến hành tẩy trùng, trong trường hợp không thể tẩy trùng – việc tiêu hủy tuân thủ theo pháp luật của bên nhập khẩu. Các cơ quan chức năng của Bên nhập khẩu gửi thông tin bằng văn bản về các biện pháp thực hiện cho các cơ quan chức năng của Bên xuất khẩu.

    Chi phí tẩy trùng, trả lại hoặc tiêu hủy vật thể thuộc diện kiểm dịch được tính vào chi phí của bên nhận hàng ở Bên nhập khẩu và sẽ được bên gửi hàng ở Bên xuất khẩu hoàn lại sau.

    Các Bên có trách nhiệm thông báo cho Văn phòng Công ước Bảo vệ Thực vật Quốc tế theo quy định thành viên và không cung cấp thông tin cho bên thứ 3, trừ trường hợp được sự đồng ý bằng văn bản của Bên kia.

    Điều 6. Cơ quan chức năng

    Các Bên chỉ định cơ quan chức năng thực hiện Hiệp định này như sau:

    Phía Việt Nam là: Cục Bảo vệ Thực vật, Bộ Nông nghiệp và Phát triển nông thôn của nước Cộng hòa xã hội chủ nghĩa Việt Nam;

    Phía U-dơ-bê-ki-xtan là: Thanh tra Nhà nước về kiểm dịch thực vật, Bộ Nông nghiệp và Tài nguyên nước của nước Cộng hòa U-dơ-bê-ki-xtan.

    Điều 7. Giải quyết tranh chấp

    Các tranh chấp liên quan đến việc giải thích và áp dụng các điều khoản của Hiệp định này sẽ được giải quyết bằng đàm phán giữa các Bên.

    Trong trường hợp cần thiết, các cơ quan chức năng của các Bên sẽ tiến hành tham vấn để giải quyết các vấn đề nảy sinh và cơ cấu thực hiện để thi hành Hiệp định này cũng như cung cấp cho nhau thông tin khoa học và các hỗ trợ khác trong lĩnh vực kiểm dịch thực vật.

    Thời gian, địa điểm và chương trình các cuộc họp này được xác định khi có thống nhất của các cơ quan chức năng của các Bên. Phía Bên chủ nhà chịu chi phí tổ chức họp. Từng Bên tự chịu chi phí đi lại và các chi phí khác.

    Điều 8. Các thỏa thuận quốc tế

    Các điều khoản của Hiệp định này không làm ảnh hưởng tới quyền và nghĩa vụ của các Bên theo các thỏa thuận quốc tế mà các Bên là thành viên.

    Điều 9. Bổ sung, sửa đổi

    Hiệp định này có thể được bổ sung, sửa đổi trên cơ sở sự đồng ý của các Bên. Nội dung bổ sung, sửa đổi sẽ được ghi nhận trong Nghị định thư. Các Nghị định thư này sẽ là một phần không thể tách rời của Hiệp định này. Các Nghị định thư có hiệu lực theo Điều 10 của Hiệp định này.

    Danh mục dịch hại, bệnh cây và cỏ dại, buộc phải kiểm dịch ở quốc gia của các Bên được nêu rõ trong Phụ lục 1 và Phụ lục 2 của Hiệp định này. Danh mục các vật thể thuộc diện kiểm dịch có thể bổ sung hoặc sửa đổi trên cơ sở sự đồng ý của các Bên.

    Điều 10. Hiệu lực, chấm dứt hiệu lực

    Hiệp định này có hiệu lực sau ba mươi ngày kể từ ngày nhận được thông báo cuối cùng bằng văn bản, qua đường ngoại giao, về việc các Bên hoàn thành các thủ tục trong nước để Hiệp định có hiệu lực.

    Hiệp định này có giá trị trong thời hạn năm (05) năm và sẽ được mặc nhiên gia hạn mỗi lần năm (05) năm, trừ khi 6 tháng trước khi kết thúc thời hạn năm năm, một trong hai Bên thông báo cho Bên kia về ý định chấm dứt Hiệp định.

    Hiệp định này chấm dứt hiệu lực sau sáu (06) tháng kể từ ngày một Bên nhận được văn bản thông báo qua đường ngoại giao do Bên kia gửi để thông báo về ý định chấm dứt Hiệp định.

    Làm tại, Ta-sơ-ken, ngày 03 tháng 10 năm 2011, thành hai bản chính, mỗi bản bằng tiếng Việt, tiếng U-dơ-bê-ki-xtan và tiếng Anh, các văn bản có giá trị như nhau. Trong trường hợp có sự giải thích khác nhau, văn bản tiếng Anh được dùng làm cơ sở.

    AGREEMENT

    BETWEEN THE GOVERNMENT OF THE SOCIALIST REPUBLIC OF VIET NAM AND THE GOVERNMENT OF THE REPUBLIC OF UZBEKISTAN ON COOPERATION IN THE FIELD OF PLANT QUARANTINE

     

    The Government of the Socialist Republic of Viet Nam and the Government of the Republic of Uzbekistan, (hereinafter referred to as "Parties");

    In order to strengthen mutual cooperation in a field of plant quarantine and to improve protection of state territory of the Parties from quarantine organisms drift and reduce losses induced by them,

    Willing to facilitate trade and exchange between two countries by seeds, planting stock and other products subject to phytosanitary control;

    Have agreed on the following:

    Article 1. DEFINTIONS

    For the purpose of this Agreement the following terms are applied:

    - "quarantine organisms" - pests, anticrop (biological) agents and weeds, in accordance with the Lists, Appendix No. 1 and 2;

    - "entomophages" - insects-eating organisms;

    - “pheromones" - matters secreted by insects for intraspecific appeal;

    - “biologies" — preparations containing disease producing nosogenic microorganisms used in latent state to fight harmful insects;

    - "quarantineable cargo" - any materials facilitating spreading of quarantine organisms (seeds, planting stock, plants and their parts, other products of phytogenic origin), imported/exported or being in-transit through the state territories of the Parties.

    Article 2. STRENGTHENING COOPERATION

    For the purpose of cooperation development and extension in a field of plant quarantine Parties are obliged to:

    - take necessary measures to prevent quarantine organisms drift from the territory of one Party to the territory of another Party during import, export and transit of quarantineable materials;

    - permanently exchange written information about appearance, spreading of quarantine objects on the territory of Parties’ state as well as exchange entomophages, pheromones, biologies and other matters to abate quarantine organisms;

    - inform about amendments and additions to existing phytosanitary rules regulating import, export and transit of quarantineable materials;

    - give mutual scientific, technical and consultative assistance in taking measures on revelation, localization and liquidation of quarantine organisms;

    - analyze problems and study achievements in the field of plant quarantine, effectively solve issues concerning plant quarantine on frontier points;

    - organize mutual cooperation of the Parties’ specialists in phytosanitary control of quarantineable materials supplied to tie territory of one Party in places of their production;

    - in emergency situation in the field of plant quarantine, upon request of one Party, send expedition consisting of specialists to undertake joint urgent measures.

    Article 3. PLANT QUARANTINE

    Any regulated articles which are transported from one Party to the other Party shall be in conformity with the following regulations:

    1. The regulated articles from one Party must be in line with the plant quarantine regulations of the other Party.

    2. A strict quarantine inspection shall be conducted before the regulated articles are exported.

    3. If the imported articles are found to be infested the quarantine pests of the importing countries, either Party, in accordance with its own laws and regulations in relation to plant quarantine, is entitled to take necessary measures to protect its plants and plant products.

    4. Straw, leaves and other plant materials capable of harboring pests as packaging or bedding materials but not including paper and synthetic materials shall be prohibited.

    5. The conveyance, packaging and bedding materials shall be cleaned or be subject to a disinfecting treatment.

    The wood packaging materials shall be treated in compliance with the International Standards for Phytosanitary Measures No. 15 (ISPM 15).

    6. When necessary, the Parties shall cooperate to carry out plant quarantine activities on the territory of the exporting country.

    Article 4. PHYTOSANITARY CERTIFICATE

    Each lot of quarantineable cargo transported from the territory of one Party's state to (or through) the territory of other Party's state should be accompanied with phytosanitary certificate issued by phytosanitary control services of exporting Party and certifying that this load meets phytosanitary requirements presented by the importing Party in quarantine permission for import. Phytosanitary certificate should be performed in official state language of exporting Party and in English. The Parties shall mutually exchange the phytosanitary certificate models and timely notice each other on any changes of certificate model.

    Import or transit of quarantineable load to (or through) the territory of importing Party's state is realized on base and conditions defined in quarantine permission for import issued by phytosanitary control services of importing Party.

    Article 5. CONTROL AND NOTIFICATION

    Competent authorities of the Parties reserve a right during import or transit of certain quarantineable load exhibit additional conditions and requirements related to its phytosanitary state.

    Competent authorities of the Parties in case of quarantine organisms' revelation during phytosanitary control in the state of importing Party have right to return quarantineable load to exporting Party's state or its disinfection and in case of disinfection impossibility - its extinction in accordance with legislation of the importing Parry's state. Competent authorities of the importing Party send written information about measures undertaken to competent authorities of exporting Party.

    Payment for disinfection, return or extinction of quarantineable load is made at expense of consignee in the state of importing Party with successive refund by consignor of exporting Party.

    The Parties shall inform to International Plant Protection as regulated and shall not provide information to the third party, unless agreed by the other Party in written form.

    Article 6. COMPETENT AUTHORITIES

    The competent Authorities for the implementation of this Agreement shall be:

    For Vietnam side: Plant Protection Department under the Ministry of Agriculture and Rural Development of the Socialist Republic of Viet Nam;

    For Uzbek side: Main State Inspection on Plant Quarantine under Ministry of Agriculture and Water Resources of the Republic of Uzbekistan.

    Article 7. THE SETTLEMENT OF DISPUTES

    Disputes related to interpretation and application of this Agreement provisions will be resolved by means of negotiations between the Parties.

    Competent authorities of the Parties in case of necessity will carry out consultation in order to solve emerging and implementing arrangements on this Agreement fulfillment as well as present each other scientific information and other assistance in the field of plant quarantine.

    Time, place and program of these meetings are determined by consent between competent authorities of the Parties states. Host side bears organizational expenses related to the meeting conduction. Each Party bears transport and other expenses independently.

    Article 8. INTERNATIONAL AGREEMENTS

    Provisions of this Agreement shall not affect rights and obligations of die Parties under international agreements of which they are party.

    Article 9. AMENDMENT

    By mutual consent of the Parties amendments and supplements can be made in this Agreement, which are executed by separate protocols of meeting being integral part of this Agreement. Protocols come into force according to Article 10 of this Agreement.

    The list of pests, plants diseases and weeds reliable to quarantine in Parties states are specified in Appendix No 1 and 2 which arc an integral part of this Agreement. The lists of quarantine objects can be supplemented and amended by mutual consent of the competent authorities.

    Article 10. ENTRY INTO FORCE OR TERMINATION

    This Agreement shall come into force after thirty days from the date of receipt through diplomatic channels of the last written notification about completing by the Parties of internal procedures necessary for its entry into force.

    This Agreement shall be effective for five years and will be automatically extended for successive five year periods unless one Party notifies another of its intention to terminate this Agreement six months prior to the end of suck five-year period.

    This Agreement shall be terminated after six months from the date of receipt of written notification of any Party sent through diplomatic channels to other Party about its intention to terminate this Agreement.

    Done at Tashkent on 3rd day of October 2011 in duplicate in Vietnamese, Uzbek and English languages, all texts being equally authentic. In case of divergence of interpretation or implementation, the English text shall prevail.
